Initial terms for evaluating and using Polaris during early access.

Early access notice

These are initial early-access terms and are not final paid-service terms. Polaris is still under development. Formal commercial terms and legal entity details will be confirmed with appropriate legal advice before paid general availability.

1. About these terms

These terms apply when you create, administer or use a Polaris workspace during early access. If you create a workspace for an organisation, you confirm that you are authorised to act for that organisation and that its users will follow these terms.

2. Accounts and workspace administration

You must provide accurate account information, protect account credentials and promptly tell us about suspected unauthorised access. Workspace administrators are responsible for inviting users, assigning appropriate access and removing access when it is no longer required.

3. Acceptable use

You must use Polaris lawfully and must not:

  • interfere with, probe or attempt to bypass the security or availability of the service;
  • upload malicious code or use the service to abuse, deceive or harm others;
  • access another workspace or data without authorisation;
  • use Polaris in a way that infringes intellectual property, privacy or other legal rights; or
  • resell or provide the service to others unless agreed with us.

4. Customer data

Your organisation retains its rights in data submitted to its workspace. You authorise Polaris and its infrastructure providers to process that data only as needed to provide, secure, maintain and improve the service, respond to support requests and meet legal obligations. You are responsible for having the rights and permissions required to submit and process customer data.

Where Polaris processes personal data on your organisation's behalf, the Data Processing Terms form part of these terms. Our handling of personal data is described further in the Privacy Policy.

5. Service availability and changes

Polaris is an evolving early-access service. Features may change, be unavailable or contain faults. We aim to communicate material changes and planned interruptions, but no service-level commitment applies unless separately agreed in writing. You should maintain appropriate copies of information that is critical to your organisation.

6. Plans, usage and fees

Early-access plans, allowances and displayed prices may change before general availability. All displayed plan prices are per user. Any paid subscription, billable-user definition, taxes, billing currency, renewal terms, overage charges or refunds will be confirmed before charges apply. We will not charge you without clearly presenting the applicable commercial terms.

7. Intellectual property and feedback

Polaris and its supporting software, design and documentation remain owned by their respective rights holders. You may use the service only for your organisation's internal purposes during early access. If you provide feedback, you permit us to use it to improve Polaris without transferring ownership of your customer data.

8. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect the service, users or data, investigate unlawful or abusive activity, or comply with legal obligations. You may ask us to close an early-access workspace. Where practical, we will provide reasonable notice and an opportunity to retrieve data before deletion, subject to security, legal and operational requirements.

9. Responsibility during early access

Polaris is provided for evaluation during early access. To the extent permitted by applicable law, it is provided without guarantees that it will be uninterrupted, error-free or suitable for every purpose. Nothing in these terms excludes or limits responsibility where doing so would be unlawful. Final warranties, liability limits and remedies for paid service will be set out in the commercial terms presented before general availability.

10. Governing law and jurisdiction

These terms and any non-contractual obligations arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from or connected with these terms, except where applicable law requires otherwise.

11. Changes and contact

We may update these terms as Polaris develops. Material changes will be published here with a revised date and, where appropriate, communicated to workspace administrators. Questions about these terms can be sent to legal@helpana.io.
